1. Purchase and Contract

The purchase of El Cartel products through the website ("Site") constitutes a contract of sale ("Contract") between El Cartel ("El Cartel" or "we") and you ("Customer"). The Contract is formed upon completion of an order and payment in accordance with Article 4.

2. Product Authenticity and Description

• El Cartel guarantees the authenticity of its items. Product descriptions and illustrations on the Site are for information purposes only and may slightly vary. Consequently, you accept that such differences may occur and acknowledge that El Cartel cannot be held responsible for such fluctuations.

• Please note that El Cartel is not endorsed by, affiliated with, or collaborating with any of the liquor brands included in its tasting collection. All trademarks and brand names are the property of their respective owners, and our collection is independently curated to offer a unique tasting experience. 

3. Sale and Pricing

Sale is confirmed upon completion of the ordering process and payment. Unless otherwise stated, prices on the Site exclude sales taxes and shipping charges, which are specified separately.

4. Shipping and Payment

• Unless expressly mentioned otherwise, the prices displayed do not encompass delivery charges

• For each order, a shipping notification email will be sent, providing the carrier's name and available tracking information.

5. Payment and Ordering Process

5.1 Payment Methods:

• Payments are accepted via methods supported by the secure online platforms Shopify Payments and PayPal.

• You agree to cover all associated costs, including duties, taxes, shipping, and handling when applicable. 

5.2 Responsibility for Payment:

• You are solely responsible for the actual payment of the purchased product.

• If payment cannot be validated or processed, your order will not be delivered, and El Cartel is not obligated to process the order.

• El Cartel is not liable for payment issues related to the operation of the secure online payment systems.

5.3 Alternative Purchase Methods:

If you prefer to purchase by phone or e-mail, please contact Customer Service.

5.4 Ordering Process:

• Place the selected product in your virtual shopping cart and proceed to the virtual checkout.

• During your initial purchase on the El Cartel website, please provide the necessary information.

• Choose delivery preferences and pay the product's selling price, applicable taxes, and delivery charges.

• To complete the order, press the "pay now" icon, indicating your agreement to the terms and conditions.

5.5 Order Accuracy and Billing:

• Ensure the accuracy of product descriptions, prices, and billing details.

• Correct any errors promptly by notifying Customer Service via email.

• Upon order completion, you'll receive a confirmation email with the paid invoice and digital Contract.

5.6 Correction Period:

• You have thirty (30) days from invoice receipt to request corrections if errors are proven.

• After this period, the information on your invoice is deemed accurate.

5.7 Customer Declarations:

• By completing an order, you confirm legal age and declare that children under sixteen (18) are prohibited from purchasing via the site.

• Purchases are solely for personal consumption, not for resale or commercialization.

• Personal information provided for billing must be accurate, and you confirm being the valid credit card holder/owner of the PayPal account.

5.8 Order Confirmation:

• A confirmation email is sent shortly after placing an order.

• If not found in your inbox, check your junk mail.

5.9 Acceptance of Orders and Cancellation Period

• Receipt of an email confirmation does not automatically mean El Cartel accepts the order.

• El Cartel reserves the right to cancel or refuse orders for various reasons, including product unavailability, pricing errors, payment issues, or delivery impossibility.

• Additional verification or information may be requested before order acceptance.

• After 24 hours, a fee of up to 25% of the sales price may apply in the case of order cancellation. 

6. Delivery and Damages

• Products are dispatched based on the chosen option during order placement, as specified in your invoice. 

• El Cartel holds no liability for delays or clerical errors in the delivery address attributable to you, or for delays due to force majeure.

• Moreover, El Cartel is not responsible for any delays or damages caused by the logistics company.

• Any damage to delivered Products must be reported within 72 hours of receipt. Please contact Customer Service promptly. After this period, the Product is considered received in perfect condition.

• In the event of returning a defective or damaged Product to El Cartel, if the original packaging is compromised, indicating damage upon delivery, El Cartel reserves the right to return the Product, retaining the sale price.

7. Return Policy

If your order has not been delivered in the condition as it should be, please contact our customer service. We’ll find a solution! 

You have 14 days after purchasing the product to return it, as long as the product is in its original and unopened condition. Shipping costs will be at your own expense.

8. Jurisdiction and Applicable Laws

Governing laws are Belgium's. Disputes fall under federal/provincial jurisdiction.

9. Modification

• El Cartel may change Terms of Purchase without notice. Applicable terms are those at the time of order placement, prevailing over other provisions.

• You declare that you have read these Terms of Purchase and agree to be bound by them. However, the terms and conditions set out below shall prevail over the Other Provisions.
